"the story" with martha starts right now. >> martha: good afternoon. i'm martha maccallum at fox news head quarters in new york. today on "the story," karl rove joins us in moments. r.f.k. jr.'s campaign manager on a threat that he faced over the weekend. howie kurtz joining us with the scandal with russell brand. first, five americans that were

locked up in the evan prison in iran now making their way back to the united states. this deal though highly controversial. the biden administration made this deal with the world's number 1 state sponsor of terrorism. it is under intense scrutiny today. national security council coordinator john kirby insisting once again that this $6 billion that the u.s. released to the mullahs will have a tight hold. >> that money goes to the iranian people. they're suffering from tough economic time. the mullahs, they never get their hand on that fund. >> martha: strong statement there's. iran's president says that tehran, since it was their money to begin with, they'll decide how they use it. watch this. >> this money belongs to the islamic republic of iran.

naturally we will decide how to spend it wherever and we need it. >> tensions remain obviously very high with the iranian regime. they have been routinely giving russia deadly drones to use in ukraine in the war there. they have seized oil tankers in the persian gulf. now the nuclear agency is slamming iran for barring inspectors from the inspections that -- under international deals that they have the right to do. they didn't let them in over the weekend. seems like they're calling the shots on a number of fronts. first to jacqui heinrich. hi, jacqui. >> hi, martha. president biden praised the release of the wrongfully detained americans and two family members that were not allowed to leave the country. in the same breath, delivered a warning that american passport

holders should not travel to iran. biden says the u.s. state department has a long-standing travel warning that states do not travel to iran due to the risk of kidnapping and the arbitrary arrest and detention of of u.s. citizens. all americans should heed those rewards. >> isn't that in a way an acknowledgement that this deal could encourage more hostage make something. >> it's an acknowledgement that iran is run by a dangerous regime that sees the united states as some sort of enemy increasingly. it means quite frankly that it's not a safe place for americans to go. >> i also asked the national security council spokesman about the timing of this and how congress finding out about this deal on the anniversary of 9-11 and the transfer happening as the u.n. assembly convenes here in new york.

how all of that serves american interests. john kirby told me the dates are a coincidence. >> it's not tied to 9-11, the u.n. general assembly. it's tied to the hard work over months and months by diplomat it's to secure this release. it's a good day for the united states and a good day for these families. >> how long was this in the works? >> many, many months. >> there's strict controls only allowing transactions to go to humanitarian causes. the criticism remains that it frees up $6 billion that iran could use for other nefarious activity. this all happens as the u.n.'s nuclear watch dog has warned as you mentioned that iran kicked out their nuclear inspectors from the country. that's happening at this deal came to pass, martha. >> martha: jacqui, thank you. a few blocks away at the u.n. john ratcliffe joins me now. former director of national intelligence.

thanks for being here. what is your reaction? you listen to john kirby. i had a conversation with him about this last week in terms of why they get five people, we get five people and plus they get $6 billion released in this deal. he's insisting this is a good day for america. obviously everybody is glad for the families that these people came home but is this a good day in terms of our relationship with them? >> no. you know, john kirby is the same one that said they're proud of the work that they did in afghanistan and the withdrawal from afghanistan that caused so much trouble for the united states on the foreign policy front. he's in a difficult position. this is a very bad deal. it sets a very bad precedent. it degrades our national security posture and it degrades the national security posture of our allies, folks like israel and saudi arabia and even the ukrainians as a result of the $6 billion that will go to that

terrorist regime that will use the money to target not just americans but american allies in the future. one of the things i don't like about this, you made the point, these five families that have, you know -- the hostages and their families that have been used in hostage taking as propaganda and ultimately sold off for profit, they're now being used as a shield by the biden administration from a really bad strategy and a really bad deal. essentially because it's hard to criticize when americans come home. we all want that to happen. but what the biden administration has done is depart from a strategy that republicans and democrats have successfully deployed over the years of negotiating for hostages and terrorists and terrorist regimes. the trump administration 58 hostages came home, three from iran without paying a penny. the departure is a terrible precedent. >> a great point. this is -- mike pompeo, who was

secretary of state and cia director in that period when you were director of national intelligence. watch this. >> think about the next person that will be taken. the incentive system is now in place. not just for the iranians but for the north koreans, every bad actor that says take an american, you'll get a billion dollars. this is material. it's terrible policy. you don't have to do this. american power can get these folks back to their families. >> martha: we know, director ratcliffe, that the biden administration has been trying to calm things down with iran. trying to put the nuclear deal back together. while this is happening, iran is giving drones to the russians to use against ukraine. iran is moving ahead with enriching uranium. they have seized oil tankers in the persian gulf. if you were involved in trying to get the hostages back, what kind of negotiation do you think would have been wise on this? >> well, as i said, we

successfully brought iranian hostages home and other hostages. with the biden administration, what they did here is a very cheap trick and went for the easy way out. i think it's part -- masks this back channel secret negotiation that they've been having on the iranian nuclear deal and other things and springing the details of this on the american people and congress at the last minute. it's totally unnecessary to do that. you're right. it's not just ukrainians. it's giving weapons to hamas, to fire against israelis, arming the huthis against the saudis. this is completely avoidable and a disaster in terms of the strategy taken. >> martha: before i let you go, the north korean-putin meeting,

lot of changes in the workplace. the senate is where traditions stand firm. chuck schumer says he's relaxing the dress requirements for senators. staffers still have to wear business attire. schumer did not say why, but it's an attempt to boost john fetterman's access to the senate floor so he can wear the clothes he feels more comfortable in. fetterman has been spotted in hoodies and shorts. he was at a uaw protest and wearing the same stuff. he mocked republicans that criticized his clothing choicing. marjorie taylor green said his dress was disgraceful. fetterman responded to her saying thankfully the nation's lower chamber lives by a higher conduct. some senators have been speaking out against the changes claiming to degrade the chamber while others fear this is a slippery

and tie without somehow feeling threatened or abused or awkward. this is just pathetic. with all due respect to the senator, we know he has some continuing health issues. but to lower the decorum of the senate, to say that an intern or a page has to dress to business suits, but the senator from pennsylvania who can be allowed to come in his hoodie and shorts and his athletic gear to the florida of the united states senate, one of the most important bodies in the world that he can come that way because otherwise he would feel uncomfortable and he would feel unpleasant and he might feel threatened or somehow made to feel bad if he's forced to wear a coat and tie like every other male in the body. >> martha: there has to be some sort of decorum in the senate, the house and the white house. i doubt that when you worked in

the bush administration that you would have felt comfortable slowing up in your sweat pants to work in the oval office much less to work in the united states senate. it just seems like it shattered -- people sort of act a little bit better, i think, when they're dressed properly for work and they have reverence for the environment that they work in, no? >> absolutely. this is an important body. it's televised. everybody else is dressed in a respectful manner. here comes the guy -- again, because it's his own personal desire, his own vulnerability that makes him uncomfortable, the body is supposed to bend to his will. he has to be treated differently. this is how pathetic his attitude is and how pathetic the majority leader is to appease him. i don't want you to feel uncomfortable or threatened or feel bad about yourself. so come in your athletic gear.

>> martha: and his people said that he was clear to perform all senatorial duties and was up to the task. you'd think that would include just applying to a very basis dress code. tough democrats bullish on biden collides with voter worries. the voters don't want this. that is in poll after poll says james carville that worried the lack of enthusiasm could lead to lower democratic turnout in 2024. you can't look at what you look at and not feel apprehension. your read on that. >> three out of every four americans think he's too old. that's seven outs of ten democrats. 2/3s of the american people think he's mentally not up to the task, which includes a near majority of democrats. so yes, they have problems. for months we've been following the stories about the lack of enthusiasm among young voters and african american voters and latino voters. now it's broken under the scene,

charges, the first time a sitting president's child has ever been indicted, hunter's lawyers claim the tax agency targeted and sought to embarrass hunter. the suit goes after the media coverage surrounding this blockbuster testimony by the irs agent and whistle-blowers in his case. >> the delaware u.s. attorney's office and department of justice handling the hunter biden tax investigation was very different from any other case in my 14 years at the irs. at every stage, decisions were made that benefitting the subject of this investigation. >> martha: hunter's lawyers say the whistle-blowers and their lawyers publicly disclosed and disseminated hunter's protected tax return information in violation of the law. matt taibbi that reported on the suppression of the hunter biden laptop story in the twitter files is standing by with his reaction to this. first to mark lytle, an attorney for gary shapley, statements that lytle made are included in this new lawsuit. good to have you with us today,

mark. it's interesting. >> thanks for having me. >> martha: they're going after interviews that you did and shapley and the others did surrounding this. but it seems like they're angry that you talked about the fact that there was an investigation going on here. but not a lot of specifics about what is in those -- what is in those files. >> yeah, martha. this lawsuit is a frivolous fear from blocking whistle-blowers. congress wrote the law so whistle-blowers could come forward in a protected manner and shine the light on government misconduct. that's what happened here. as a result, the sweetheart plea deal was revealed and came to light and the judge rejected that. they're mad about that. they're coming after the whistle-blowers.

it's frivolous lawsuit, martha. >> martha: one of the things that they do cite are the specificing about the things that were in some of those returns. including business expenses that were written up as prostitute payments, sex club memberships, hotel for drug dealers and he owned $2.2 million in unpaid taxes. they're suing the irs, not you or your client. the irs was im prproper to allo that information to get out. >> they're flat out wrong, martha. all of these facts were le legitimate disclosures. it allows people to come forward in possession of private confidential taxpayer information and to disclose it to congress so that they can look in to misconduct and abuse. in this case, by the department of justice, particularly by u.s. attorney now special counsel

weiss. as the agents that are experienced agents testified that there are numerous -- just confirmed there's numerous steps where it was slow walked, where steps that could lead to president biden with stopped and blocked. that search warrants weren't followed through with and ultimately this plea deal, which was really an embarrassment and to the judge got thrown out. one of the biggest things here is the fact that the whistle-blower -- the biden attorneys have tried to attack this. they were written letters to the department of justice to criminal prosecute these great and brave agents. that was rejected. in their own documents, it says that leo weiss rejected that. ultimately they tried a motion to seal the judges based on the judge. she rejected that as well. >> martha: we saw what happened in the courtroom. thanks, mark. good to have you with us today. thanks. >> thanks, martha. >> martha: with that, we bring in matt taibbi.

in december he published "the twitter files" that revealed the company's internal communications against the suppression of the hunter biden laptop story just before the 2020 election, which reveals some back and forth between the administration and social media companies and how they were trying to craft the relies of that information and whether or not people would see it. matt, great to have you with us. thanks for being here today. >> thanks, martha. >> martha: there's irony in the fact that hunter biden is going after the irs and the doj for weaponizing his personal information when the shoe had been on the other foot with these whistle-blowers that came in and said we're with the irs and clearly the irs and the doj have been, you know, weaponized in his favor. they're try to protect him. what do you think of that, matt? >> yeah, certainly ironic, isn't it? seems like the government bent over backwards to keep information that was clearly newsworthy out of the public

domain. as the result of a variety of things, including censorship of this story. we didn't learn for a very long time through these whistle-blowers that there was this whole galaxy of shell companies, you know, that hunter biden was tied to. i don't see how he could possibly claim that the disclosure of this kind of material is a personal violation when it's so clearly relevant to a public investigation. >> martha: what do you think is the strategy of this lawsuit? there's expectations that there will probably be more, right? is this a sort of large p.r. campaign or part of his campaign to push back against all of this and do expect more it? >> well, certainly they're going to avail themselves of every legal means that they have at their disposal to try to slow this thing down. i think in a larger sense, you know, there's some p.r. value in

trying to present hunter biden as, you know, a confused person who had personal troubles that is now the victim of this investigation. this goes to that. it's actually a smart move on their part to do this. i don't know whether it's going to work, but i can understand the lawyers thinking that they should do it. >> martha: it's interesting that he's going after the agencies that are essentially part of his father's administration in this way, right? >> well, right. yes. >> martha: never seen that before. >> as soon as they start behaving like independent entities, of course they're enemies of hunter biden. that is certainly ironic. the evidence shows that they bent over backwards to tray to accommodate him, even when he said ridiculous things like trying to claim that income was a loan when clearly it's a taxable event as soon as he gets it. they hid this stuff and now it's coming out and he's upset about

mr. kennedy's president was assassinated. robert f. kennedy was assassinated while a presidential candidate. candidate r.f.k. jr. expressed his gratitude for the security team in isolating the man at the event until the lapd arrived. his father, robert f. kennedy was assassinated in los angeles 55 years ago. a secret service spokesman note that's it does not determine when candidates receive protection. kennedy wrote about this incident on x. "i'm still entertain ago hope that president biden will allow me secret service protection, adding i'm the first presidential candidate in history to whom the white house has denied a request for protection." some say that withholding secret service protection is a political decision, not a legal one and clearly there's concerns that it could be very dangerous. martha? >> martha: thanks, mike.

mike emanuel in washington. with that, we bring in dennis kussinic. great to have you with us. thanks for joining us today. i want to pick up on the tail end of mike's reporting there. it raises this question, given the kennedy family history, given the request for protection, now given this threat by this person pro tending to be a u.s. marshall, do you believe that the biden administration is not acting on this out of a political drive? >> well, i don't think there's any questions that this is a political decision. president biden has within his power to direct the secret service to protect mr. kennedy. he's chosen so far not to do that. we have appealed to him. i sent a letter this morning once again asking him in the name of fairness and not just

protecting mr. kennedy but everybody around him. we have not received a positive response given the escalating danger of the security environment is astonishing. >> martha: here's miranda devine in the "new york post." she session what does it take for joe biden to grand robert f. kennedy jr. the secret service protection he's been asking for. does he have to be more tally wounded like his father or uncle. have you received any response from the white house on this? >> not yet. i just want to say, miranda devine is a journalist who has her fingers on the pulse of what happens in the country. all americans are starting to become concerned. why isn't mr. kennedy particularly given the history that fox just laid out, why isn't mr. kennedied receiving secret service protection especially in light of this recent incident? so we're continuing to appeal to

the president to listen to the angel's better nature and grant this simple request, which is not only about protecting mr. kennedy, it's protecting everybody in that environment with him and it is about protecting the american political process itself. we do not want to go through what this country went through when president kennedy was assassinated. we cannot do that again. let's just -- what does it take? that's what i'm saying. what does it take for the president to respond? >> i guess the obvious point here is there appears to be an effort to pretend like he's not running, this campaign isn't happening. we see it in some of the media around this. we see people saying why isn't anybody running against the president? your candidate says, well, hello, here i am. i have decent poll numbers that are better than the republicans that make the debate stage. so maybe it's time for people to

>> martha: comedian russell brand accused of sexually assaulting four women, including one that said she was 16 at the time according to the british media. now investigators say more woman are coming forward according to them and promoters have postponed his upcoming shows. russell brand denies all of these allegations. he says his relationships were always consensual. the 16-year-old was legally old enough to consent in the u.k. she says it started out that way, but that brand eventually assaulted her. she tells the times of london, "my mom still feels like she

failed me in some way and allowing this to happen but she had no recourse at all. shouldn't be legal for a 16-year-old to have a relationship with a man in his 30s. with that, we bring in howie kurtz. this is a big story in the entertainment world that broke over the weekend. obviously russell brand is a very outspoken actor, now podcaster and he has a podcast called "being free" which has aligned with a number of libertarian political philosophies. what do you make of what's going on here? what have you learned? >> the question i would ask, why would these several women make this up. yes, three of the four are anonymous and the alleged incidents took place 10 to 17 years ago. the level of detail from the woman you described, alice, who was 16 at the time, and i don't see a reason why she would take on a celebrity, he said she was

movies and hosted tv shows and so forth. this has gone off like a neutron bomb in the u.k. where as you mentioned many of his tour dates have been cancelled and the prime minister's office responded and said these are serious concerning allegations. the london police have gotten a new allegation and invited women to come forward. we don't know what happened. but again, because especially since the alleged incidents took place so long ago. but it's hard for me to understand why women would want to expose themselves to having their lives turned upside-down by coming forward if this wasn't true at least as they recall it. >> martha: yeah, obviously when these things happen, all sorts of clips from the past surface that raise questions about people's behavior. here's a moment on jimmy fallon with katherine mcphee. >> katherine is welcome to sit here. >> no, don't. don't even say it.

>> we're going to do -- >> for the queen. >> martha: you know, i mean, howie, obviously moments like that don't mean anything in terms of this case and what it has -- he's entitled to due process and tell his side of the story. this is an investigation that will have to be decided in the courts, correct? >> right, a huge difference between jokes about being flirtatious and what would be criminal acts if they were to be true. there's been some criticism about the woman didn't come forward until journalists contacted him. that's how the harvey weinstein scandal was broken. i don't think that's any reason to rule it out. i think his career has to be on a hold for now. he will have to prove his innocence and more investigating, including by some of the british media organizations that he worked for in the past. >> martha: this 16-year-old says her mother let her go on a date with him. she got all dressed up looking
